Right, but there’s nothing that says the three comparable rents have to come from a single 10 list so it’s possible that finding three properties of the same size/BER/bedrooms etc could be on three different 10 lists.

If the most recent RT date (most important detail imo) on the 10 list is the only new registration in the area, then pick another two from nearby. Or there might be none. So three other 10 lists are needed.

They say landlords have to:

So if a landlord does what they’re telling him to do, they can’t really dispute the amount. Unless it’s higher, then an EA valuation is probably needed.
 
Even trying to use the rent register as posted above, it’s not a very useful tool because it takes no account of different areas within an LEA.

An owner could have a 3bed of 100sqm in D9 or D3 that sells for €1m+ (and consequently commands higher rent) and literally around the corner, a similar size house costs half that amount. I’m sure that’s replicated all over the country.

There’s no way the rents for those two properties are, or should be the same, yet the 10 list shows rents based solely on size with no weighting for any other attributes the property might have. If the purpose is to curtail what an owner can charge for their property, that sounds like an interference with an owners rights.

But you are still using the Register, just a different LEA which you must justify

This is a very symplistic reference rent system. It doesn't work because of that. I'd expect it to get more complex over time which will probably only add to our woes.

The more changes are introduced, the more it sounds like the old rules they had under the rent restrictions act. But those old acts were found unconstitutional because they arbitrarily limited rent. Afaik, the Blake case removed statutory rent controls and security of tenure because they were against an individuals rights, ie, one citizen’s rights targeted for the benefit of another. It doesn’t seem much different now.
 
I was playing around with that rent register all day and its a total shaft. I was already getting out but I was very curious to see how the rules would screw landlords over again in the end, since they said that they were making the changes for landlords. Well now we know how. Total stitch up job.
I really dont understand why anyone is still putting up with it tbh. Sell, take your money and enjoy your life without any worries of trying to keep up with the residential rules.
 
I fully expect investigations for breach of the rent setting rules against landlords who use Daft. It is clear that you must use their very cooked Register or else
 
I attended the RTB Zoom call this morning titled overview of rental law changes. One thing I picked up is that RPZ system is effectively gone and has been replaced by a "new national system of rent control" and this term is now widely referenced on the RTB site. So although RPZ's were a temporary measure and supposedly recently expanded nationwide, they are now gone.

Did they mention at all that their market rent calculator is not fit for purpose?

I just read that our housing minister has rejected claims that his new rent controls are the cause of the NOTs in Wexford. It would be so funny if they came out with a statement saying "Yes minister, they are only because of your new rent controls"

He claims that saying they are selling because of the new rules is 'misinformation'

They've owned these properties since 2017 it seems and by sheer coincidence they decided to sell them all now just when the new rules came in.
 
@Greenbook the session lasted 30mins in total - 15mins or so presentation followed by 15mins of Q & A's from questions submitted during the call. An overview of rent register was given alright where the presenter inputted a sample eircode, ber, etc and showed the results retrieved. No explanation was given as to how data in rent register was complied and questions if any about this weren't covered...
 
I used the rent register on the rtb website, rents were much higher than expected and in line with market rents i am seeing on rent.ie

Go figure.

It's making my decision to sell or rent a property more difficult

House is a 3 bed in Crumlin (Dublin).
 
I put in eircode for house next door to mine. Same size house.. My house did not come up as one of the 10. Despite there being at least 10 rented houses in the estate only 2 from same townland appeared, the rest were miles away though same LE.
 
I wonder about the potential for uneven treatment of small and large landlords by this system. If a small landlord is forced to pick three comparable local properties these may be of varying quality and therefore rent. If a large instutional landlord picks three it is likely that s/he owns these - they may be in the same block and all chargng high rents. Or am I over thinking this?
