They are definitely cost rentals or social housing. They should not be on the list at all.- a full page of A2 BER, and all the rents in Ballysimon are EXACTLY the same. (I don't know where Ballysimon is ?) That looks ot me like a low rent of property in exactly the same place, like a developer or Cluid or something? Anyone make sense of it please? In the entire list there are 22 exactly the same at the €990 .

I agree that is what she said. But the RTB informed me they have no statutory time limit. That the RTB can go back to the start of the tenancy regardless of the time passed and that one could get an order against the landlord of the overpaid rent plus a find of up to 20K !she specifically pointed out it was a criminal offence to incorrectly set and review rent. She stated clearly they will be proactively going after accommodation providers that set rent above market rent. And also said they can mandate refunds going back as far as 2019.

Apologies to you Wavelly, I've been away and missed your post.The rent register results now seem to include a new column to distinguish between new tenancies and annual registrations, and brings up 30 results instead of 10.

Yes I have seen some paperwork where this 3 month is mentioned alright.But if the rule is 3 months than what do you do, you could easily be out by a month and not know it ....

From memory, a thread here may have a screenshot.They confirmed to me (after double checking with their colleagues) that there is no rule that you have to take rent comparables specifically dated in the last 3 months.
When i contacted them on this they had no idea there was a 3 month rule on their website. So they asked me to send it to them! Which I did !! I only knew about it beause another poster on here told us about it. You can barely rely on the RTB, because they get things wrong. RAS tenancies are also on the register (I've seen my one). That was rented at 8% below market at the time of first letting (much further below market rent now). The 8% discount to market is standard for the scheme. There is about 16,000 RAS tenancies in the country, so that alone is ~7% of the register that's below market rent by definition.By including old RPZ rental, cost rentals and possibly social housing as well, the RTB is deliberately making it impossible to justify an increase to market rent.
