PTSB ptsb withdraws appeal to Supreme Court on trackers; CBI taking enforcement action

If you are outside 6 month time frame 2 things might help
1) CB enforcement action might dictate its retrospective to all affected parties
2) Statute of limitations for fraud is 12 years so if you could prove it you would have to go to Court

This person wasn't sure of the exact dates so was going to try to find out more information. I think that because there is so much media hype around this issue, anyone who is due to be refunded will be. Hopefully you will get a letter in March.

Actually I got it slightly wrong for Fraud the 6 year clock starts ticking from when you found out about it...so you could use your post here as proof when you found out about it!!!

The FSO 6 year timeline is different in that they can only look back at most 6 years

Hi southside 100 thats great to have a contact. Im slightly confused on the dates though. Most of us broke out of our fixed in jan / feb 2009 so surely they will be checking that and not just 200y-2008?? Keep us posted.

I would say that date range is to check each persons original loan contract or terms. They probably know it was during that period roughly the terms and conditions were worded that way. So they might check to see what customers during that time had those terms, and from there then work out which ones then fixed and broke iywim

I previously posted this and have it in writing

We werent penalised either and just so everyone know when i questioned ptsb in my complaint about no penalty they wrote saying it was due to a system issue they had (ithink it was around jan - mar 2009) how coincidental lol. So i further complained that they never bovered telling us after either. Id say theres 1000s of customers that dont have a clue about ptsb mistreatment of there customers. Im awaiting fso decision on my case pending the supreme court ruling but as thats not happening fingers crossed

bpw I have the same letter from them - system error on their part - coincidence is right!!!!!! I also never received any correspondence from them stating that there was an error. I checked my Letter of Offer and the rate I should be on is 1% above ECB.

Nice 1 matan mine doesnt state the rate it just says tracker rate then prevailing so that will probably be another fight ill have to go through with them.

Looking at what southside100 said again today, at least they have accepted they are refunding customers affected, it is another battle I can do without.

This has consumed me for far too many years, I remember the day I re-read our contracts because of the 6.3% SVR we were on like it was yesterday.

I will certainly not be sorry when it is all over.

Agree Taldar will be happy when this is over. I hope we will all leave each other knw when we receive letters from PTSB. I knw they said it can take up to 3 months it's the patience u need. Has anyone wrote to PTSB asking if their a/c is being looked at???

Hi Hopefully,

I haven't contacted PTSB since we received our letter from the FSO. I will notify all involved on AAM when we receive communication from PTSB.

I haven't received anything from P Tsb either but will let you know when I do. I think people shouldn't ring or write because if we all do then the staff in P Tsb will get nothing done, just sit tight and wait (easier said than done I know).

I submitted a formal complaint to the PTSB when the investigation came to light earlier this month and requested them to send some copies of documents to me. They did send my documents and with it was a letter (a generic letter) stating that they are looking at all mortgage holders who lost the right to their trackers when they terminated their fixed term early. They stated they could not say anything else as the investigation was ongoing and would contact all customers affected once the investigation had concluded.
(3 months is the investigation time - I was told over the phone before when I contacted them for an email address to submit my complaint).

It will be 4 weeks this week since announcement so hoping for a letter at some stage early this month preferrable this week! Ok, promise, not another word until I recieve something! :)

I got a letter from them last week, it was in response to the complaint letter i submitted a few weeks ago.
They just said they are looking into everyones mortgage account who broke from a fixed term early and were entitled to a tracker at the end of the fixed term. And that the people effected will recieve a letter from them in approx 3months.

A frustrating update, apparently the letters will now be delayed until the end of March, it seems to be the CB delaying this for some reason. The first tranch of letters will only effect loans that broke out of fixed rates from Jan 2006 - Aug 2008. So I guess if you broke out of a fixed rate outside of those dates you will need to be patient and wait that bit longer.
