We visited last Summer, but nothing has changed in the aerial photos since then. Have you paid for the land yet?

Earlier in this thread there was mention of a golf development was this development also run by JC?

no golf in this development, he put us up in dalbert last year which had golf beautiful place i believe ther was problems with that development too met some irish before we left they thought there might be a connection and yes we have no more payments to make this is why we are so frustrated

this is quite slow isint it ill log on tomorrow to see if any one else has anything to add and i will talk to friends of ours who also has bought be careful before you go any further it might even help us too i am so looking forward to sitting in my hot tub at number 52 with my glass of wine while shouting over to number 84 to check the barbie!!

im goin to have to take action its with the solicitors now dont want to go over but if i have to i will next week a surprise visit

I am so glad that I have found this site, I have been on my own for the past year not knowing what to do.

We should all meet up somewhere to discuss this situation.

Thanks again for coming online this evening to offer some support. Be in touch

Hello all, sorry I couldnt make it at 9 last night, familly trouble :). I am trying to organise a flying visit in June. I have paid half the money at this stage. Aoife Marie, if you have only paid a deposit I would definitely not pay anymore until you see real progress.

It is easy to see this but looking back i wish I had insisted on a finishing date in the original contract, it would be easier to argue that the contract was broken and pull out.

careilly, you mention going to a solicitor was it an Irish one? Can you reccomend one? I think a solicitors letter to JC would do no harm

Hi Chemking,

At the time that I went to pay for the land, the Irish Notary would not approve my signing until a French Solicitor had advised me that the contract was in order. My French Solicitor was not satisfied that the terms of the contract were in order and would have preferred a revised contract. The solicitor said that this was not a standard French Leaseback Scheme and hence many of the protections which are standard are not in the Scheme offered in the contract from JC.

Hence, I have not paid over the remainder of the balance for the land as yet. I am still interested in this investment, but as you advised, I will pay no more until I get some positive feedback on completion dates, etc.

my solicitor dosent know much about lease backs but he is having a look at the contracts for me aoife could you email me the french solicitor might be a good idea to use the same guy

Sorry for the delay in responding to your post, IT complications.

Presuming this project will be completed eventually, we will have to form a committee to monitor the situation, so now is as good a time as any to get to know each other and lend support. This is a totally open forum, hence we are all reluctant to give out too much personal information.

I have spoken to various solicitors and notary officials over the past few months about this situation, basically Irish solicitors do not deal with French property transactions because their laws/guidelines for purchasing land, property etc. are so different to ours.

The French solicitor that I employed advised me to walk away. But don't get excited I am still interested in this site, and think that we should all meet up and discuss the situation.

Wasting money with solicitor letters will possibly get us nowhere at present, wait until one of us takes the opportunity to visit JC or else arrange a meeting between us, then we can act jointly.

God i couldnt walk away not after all the money we have spent. I really want this to happen and i know it will, but its just the lack of communication from jc is worrying we have flights booked to go over 26 of may we want to gather as much info as possible if anyone wants to join us they are welcome especially if you can speak french he is depending on us to completely to fund this project with no loan from the bank.

I am an Irish girl living in France. I have worked with companies selling leasebacks in France. After reading this thread I felt compelled to offer some advice. As my job involved acting as an intermediatary between buyers and the developer I understand your frustrations. Leaseback developments often do not complete in the time buyers are originally given. The main issue is always the language barrier. As there are a group of you with simimar issues and worries, my suggestion would be to arrange amongst yourselves to write a letter outlining your worries and concerns, include the questions you have and then have it translated to French and sent via registered mail directly to the DEVELOPER. There are several translation services available in Dublin and it costs about 25 to 30 euro to have a letter translated. It only takes a few hours. Asking the questions in French is truly the key to getting the answers to the queries you have. Hope this helps...

hi
i've been away for the last 2 weeks and just saw the recent posts. i have only paid deposit so far but obviously would be still reluctant to walk away completely but i am def not paying any more money until i see and have more commitment to finish date. i wrote an e-mail to jc & to brian moore but of course no reply.my solicitor doesn't know about french law so was reluctant to advise.if any of you know a good solicitor who knows french law maybe we could all get together and share the cost. here is an e-mail i recieved maybe it might be worth writing to them also and putting some pressure on.

From your forum posts you seem to have some leaseback problems. If you think publicity would help please contact Martine Denoune (mdenoune@lesechos.fr) who has written about leaseback issues for the financial paper Les Echos - [broken link removed]
She would welcome input in French or English from owners who are having difficulties with their leasebacks.

I had not realised that JC expected us to completely pay for this without a loan from the Bank. Has everyone else paid cash directly to the Moores or JC?

I am unable to go over to France during the next two months due to work commitments, but I am very anxious to hear how you get on and what you can find out. Have you received any confirmation on the purchase of land for your plot yet? Will you get the title deed to your land when you visit on the 26th May?
