Yes and hopefully the fspo will take into account there was a culture at the time to deny the customers there contractual entitlements, the banks were fined for their misdemeanours however the customers who were affected the most still have the anxiety of years for an outcome eventhough the banks have been imposed fines, the customers are left to the end, hopefully we are getting to the end of this
 
what pace do these guys work at, its beyond belief... December 17 was the 'breakthrough' on KBC cases.. We are waiting since that for the this cohort to be addressed,
 
Agreed and where there’s any doubt banks should act and err on the side of the customer .
 
I spoke with the KBC tracker team today and they said no new case types or scenarios have been added to the in scope tracker mortgages in recent past and they consider the matter finalised. That’s the standard response expected, but it also tells me the FSPO hasn’t issued final decisions yet on any of the flyer impacted scenarios. They also didn’t know what would happen after any possible sale to BOI but my assumption is any case to be raised still stands.
 
Hi, I understand that the Ombudsman has set out findings today on 25 cases that were being investigated, can someone please let me know where the KBC Flyer cases are at, this is just 'dragging on forever'

What I am concerned about is Kbc will leave the irish Market before it gets to adjudication as this whole process has taken years and still no updates, if kbc have left this jurisdiction it will make it more difficult to resolve
 
The FSO has only 6 full time legal officers (totally understaffed) and at this stage is a joke in terms of its mission statement for being prompt. Email all your TD’s about the delays you are experiencing. This, together with the EBS variable rate ISSUE have been dragging on for so long that some of those affected could have passed away. The Financial Institutions that fund this statutory body must be laughing all the way to the BANK.
 
Its the complete lack of clarity and communication on this that is so frustrating and you are right 'Darmatters', people will have passed on before this has been dealt with. It really is a joke.

My case is with the FSO for the last year. I contacted them last week and the reply I got was, they are extremely understaffed at this moment and my case is the queue to be investigated. It is really frustrating! how slow the process works.

Does anyone know what implications these KBC loan sales will have on our Tracker issues, the process is really really slow and is taking way too long. Does anyone have any further update here?
 
Hi Calamity, I rang kbc and the answering machine said on 30th August 2021, my loan was sold and I will get a letter in the post, not to sure how this will effect my tracker case and I am not sure whom my loan is sold to
 
The wait seems endless dragging on years now still with KBC , but sorely tempted to move to Avant etc and fix after few years on kbcs variable… the options/rates BOI will offer are unattractive to say the least ….. how messy will it be if i got positive result from ombudsman and had already switched to other provider ?
 
Yes my wife keeps telling me to move it to another bank to get off the crazy bad rates but like you I’m afraid of the mess or loosing out if by any chance things are found in our favour.
 
Shortly all kbc customers will be contacted about moving to bank of Ireland and pepper, how will this impact our cases

Just a quick update,
Firstly, I am not looking after my case directly. I have a specialist in this area doing all the work.
KBC responded to my letter of complaint from the ombudsman. They replied with "they never were entitled to a tracker because of X, Y & Z etc. I have 10 days to add any additional information to my case before it goes to adjudication. That should take about 6 weeks. To give people a time frame, my case was lodged with the ombudsman in June 2020.so the process takes roughly 18 months.
