The data is gone, there's no way they or anyone else can prevent future exposure. Even most organisations that pay the ransom see their data later sold on or exposed by the hackers.

What about those who didn't start any proceedings initially, can they pursue a case now?

. . . I don't see any prospect that writing a letter to the HSE is going to elicit an offer of €750. The current offer is only being extended to people who have actually instituted legal proceedings.
