Does anyone know whether it is permitted to have a dog in the apartments that have their own door??

i dont think you can have a dog. i bought a 3 bed duplex with my own front door and it was in the contract that no pets were allowed. its the management company that dont allow it. i think thats crazy, like how could they enforce that?

How can they enforce it? You have to sign that you agree to the terms of the leasehold agreement, so it's probably a matter that could see you in court if you fail to abide by these terms. Same as satellite dishes etc.

The Managment Company ultimately is the owners of all apartments, so if enough of you agree, you may be able to change the rules at some time in the future. There is a provision in our agreement that allows the management company to make special provisions if owners present a case on why they should be a allowed t have a dog, satellite dish etc.

Hi guys,

My car was broken into and all the windows and lights smashed when it was left in the car park at Portmarnock Dart Station overnight. The Gardai who were called that day had already been called to the Dart station twice that morning as three cars had been stolen/ smashed the evening before. According to the Gardai, these car thefts are a regular occurence and there is not a lot they can do about it. When I mentioned that I was moving into the Kilns, the Gardai stated that it should be our No 1 objective to get security gates - otherwise we would constantly have problems with cars being stolen/ broken into. Apparently, the DART gives the guys very easy access into the station and nearby developments.

So I really do think we should all be making observations to the Appeal on the security gates. We have until Wednesday 12 April to make an appeal. I have attached an extract from a letter from Peter Coyle which gives all the info,

"The Developer has submitted an Appeal to An Bord Pleanála on 16 March 2006.

From the date of the Appeal, anyone can then, within a further 28 days, make an Observation to an Appeal. The Appeal in this case was lodged on 16th March 2006. Observations have to be submitted by Wednesday 12th April.

It costs €50 to make such an observation.
I have forwarded my own Observation to the Appeal (copy attached).
Appeals are normally decided within 18 weeks.

The Reference Numbers are:

Fingal CC Planning Ref. F05A/1827


I would encourage others to make an Observation to the Board."

That is a disaster on the pet front we have two yorkies and have bought in block 3. will have to get solicitor to check out.

I asked Sherry Fitz specifically about having dogs before I put my booking deposit down and I was told that it would be fine if it was a small dog, and that management companies usually overlooked it if they were quiet etc. Having said that, when I checked with my solicitor who in turn checked with issuing solicitor he said that they were saying no way.


Doesn't really help either side but just thought I'd let you know what result I got when I asked.

Dogs are never usually allowed in such developments ...soiling grounds,any communal corridors, noise to neighbours etc. It is different where local authority have the roads in charge - in a private development other residents can (and usually will) insist others abide by the stipulations in lease. Very surprised that Sherry Fitzgerald said it was OK.

May be different because it's not apt block, it's a "own hall door apt" or maybe cus they would have said anything to get me to pay my money!! who knows!

Given that they are the selling agents, nothing much they say would surprise me.

The estate agent is no good to you on the dogs/pets issue unless they lobby the builder to get the leashold agreement changed. That is the only relevant source of info/'law' on the issue.

is it fair to coop a dog up inside an apartment all day? in any case, there are few people who'd want to shell out almost 350k to find a mutt barking its head off next door. i thought it was pretty clear that pets of this sort were not allowed

not everybody is out at work all day leaving a dog alone, but yes I agree a barking dog in close proximity would be very annoying

Apparently the ESB are holding up things, and once they manage to hook the site up, Block's 1, 2 & 3 will be ready for snagging. Sherry Fitz are saying the end of June for Block 4, so presume Block 3 will be a bit before then?

Regarding the dog situation, I was in a similar position when I bought in Portmarnock about 2 years back now. The mgt company rules stated no pets, but as we already had one and for a good reason, I presented my case. Basically the rule is there so that if somebody has a dog that soils the common areas or causes disruption during the day then the mgt company have grounds to take action. In my case neither problem would happen as the dog doesn't bark at all because my other half is home most of the day,and the dog is walked on the beach so is never on the common grounds. This I think is a fair understanding. If disruption was caused to the neighbours and if a complaint was made to the company then I could understand if further action had to be taken

I also was told by the foreman that they are now in a situation where they are waiting on the ESB in order to progress the first 3 blocks to snag list conditions. Not sure when this will be resolved thought as they have being waiting about 4 weeks to date.

That is a pain about the ESB they are such a disaster. Will give SF a ring and see what the crack is.

I just spoke with David Brown and he said that the builders told him yesterday that block 3 should be due for snagging in the first two weeks in May. builders solicitor will contact ours so might be worth a call to your solicitor to give them notice that this will be coming in then.

I have been informed that the next phase is being released after the summer according to Sherry Fitz. They said that they are releasing apartments and some duplex too. Does anyone have any idea what the cost of a 2 bed duplex would be, sherry fitz said could be up to €450k, also any idea of the sq footage of 2 bed duplexes?
