Terry Gorry video on his difficulty getting rid of a non paying tenant

Permit me to quote from the Irish Examiner (which repeats what I wrote above):
I would not rely on newspaper reports. They have zero knowledge and even less interest in reporting these “boring” cases to the public. Especially in an anti landlord Irish society context.

One caveat to this particular story, it’s entirely possible the tenant phoned the RTB and was given shambolic advice.

Take a case against yourself to the RTB on the grounds of the validity of your notice.
In parts of America the trick to get rid of non paying tennents/squatters is to give a valid rental agreement to a trusted relative/friend. Then have them call the police when they cannot gain access to their property. The police will kick out the the squatters there and then. Saving a long drawn out series of court cases.

Maybe I’m clicking the wrong link but the YouTube video mentioned in the original post has been removed for violating YouTube rules.

Determination Orders are public documents as far as I’m aware, as I’ve read many of them.
Yes, they are. In fact I would always do a search of a prospective tenant's name to see what turns up. 100% public documents, names, address, details of what happened. Very strange if it was pulled because the tenant was named. Publicity is a risk you take if you take a case to the RTB. Details are published by the newspapers as well of the juicier cases, again, with names of those involved.

Greenbook, you’ve just given me an excellent idea, ask perspective tenants not only for references etc, but ask them for their exact proof of RTB registration. After the references. Thereby knowing if they were registered etc. Anyone with no issues and normal landlords wouldn’t have a problem with this. (Not currently a landlord, but going back in, very hard though, strict, not like we were before, it worked out, but society has changed, and the regulations are unreal)

Found the video on Tik Tok, the RTB issued a determination with an address error. The district court judge then rejected the determination on the grounds of said error and RTB then claimed they can't correct it as they can't reissue the document under the legislation (or something along those lines, doesn't make any sense to me). Four visits to the district court and the determination refused each time. For a tenant that hasn't paid rent in 2 years! The system just seems to be set up to gouge free housing out of anyone stupid enough to rent a property out, the government is saving money presumably in many cases as they should be housing the people who can't make rent, but instead are just leaving them as non rent paying guests of private landlords.

Take a case against yourself to the RTB on the grounds of the validity of your notice. So that you know sooner, rather than MUCH later, that the notice you serve is deemed valid by the RTB.
That is good advice. Thankfully I have already had a hearing with the RTB (for over holding). As part of that process, the notice was deemed valid and a determination order issued in my favour. The (now ex-)tenant left the property, albeit, in a bit of a poor state and also did not pay some rent due towards the end of the tenancy.

I am aware I am getting off light in terms of rent due, but they caused a lot of damage requiring a lot of work a few thousand to make everything right to sell it. These were the worst tenants I had in 25 yrs of letting multiple properties.

25yrs on, I would not embark on property letting. Its just not worth it and the necessary legal and regulatory supports are not there to protect landlords from bad/troublesome tenants.

@ClubMan Thanks, worth watching.

I'm wondering - in such cases does a landlord have the power to get the electricity, water, gas, whatever disconnected?

Is there a reason we don't see wages garnished for rent defaults? Attachment of Earnings Orders are provided for in legislation but I have never heard of one being applied for arrears/overholding. I think the idea of your employer deducting arrears from your salary would make people think twice.
