Due to pressure of work, a bank employee is on sick leave.

The bank have now offered to arrange and pay for whatever medical consultations (from a designated panel of professionals who deal with the conditions) are necessary for the well-being of the employee.

My questions are

1) Do the bank get a report from the practioner on the employee's condition?

2) Can these reports be used to terminate employment at any stage in the future?

Would be grateful to hear from bank employees who have been in this situation before.

I can't comment on every bank but having worked for a couple in the past, on occassions where my staff visited one of these doctors the normal practise would be for the doctor to prepare a report which was usually sent to the HR department. As line manager I never got to see the report, albeit HR may give me a verbal synopsis on what was on there. most of the time it simply confirmed what was on the staff members sick cert.

In addition, if this was a long term sickness case and the employee was being moved off the payroll(assuming employer pay sick pay for a period) and onto long term insurance payments, insurers would also require such a report

An employer is not expected to hold open a position indefinately if a person is physically incapable of doing the job.

Employers cannot force employee to attend company doctor and have no legal right to see medical report. However, employee has no legal right to sick pay so it's usually in their interests to waive confidentiality and submit to an inspection by the company doctor. In which case, yes, it could potentially be used to support a termination due to inability to perform job.

Thanks for the replies.

Is there a set period that the sick employee stays on full pay? If so, what is the usual procedure for removing an employee for full pay - how much notice is the employee given?

What happens after that?

It depends on the terms of your employment, some employers don't pay any sick pay, and any that do pay usually do so minus any social welfare payments made as a result of the individual being off sick.

I know in the case of my own employers it is 6 months full pay - social welfare deductions, 6 months half pay minus sw deductions and then if their insurer agrees, they move onto long term insurance payments which are 66% of weekly salary -sw payments.
