I though that OMCs were supposed to have an AGM every year and also publish accounts/financial statements this year. The OMC for our complex has not done so and stated that it is not holding an AGM this year. I tried unsuccessfully to contact them about this over the last two months. There are some concerns from other owners as well as myself that the complex is not being well maintained. I understand that the OMC hires the managing agent and the managing agents answer to the OMC - is this correct? Many of us have made maintenance requests over the last 8/9 months which have all been ignored. Any comment or advice on how to proceed here would be very welcome.

Yes.

Who are the directors of the OMC? Who in particular is identified as the company secretary, the contact for legal matters and communication with the board?

Also correct.

You are within your rights collectively as property owners to call an Extraordinary General Meeting if you have concerns.

Do you have a copy of the OMC charter?

HI! Mathpac, thanks for your reply. I don't know who the directors are. On the OMC website it doesn't say, nor does it have their charter. I presume all this is available through the Companies Registration Office? Do I get the all of us to call and EGM. I understand also I can refer to the Director of Corporate Enforcement - am I correct. Which comes first EGM or Director of Corporate ENforcement.

You should all stop psying the annual management fee. Thst should bring them to heel.

The OMC board directors are on the last statement you got about your annual charges. I presume you mean Managing agent has a website above.

Hi! Elacto, we got no statement about annual charges at all - just an email to everyone that the charges were due - 1950 - and had to be paid by a certain date. No statement, no list of directors, nothing. The OMC has a website not the managing agent it is ouromc.ie - it seems to cover several OMC's and then you login and your particular one comes up.

I'm not sure that this is good advice. It's similar to telling someone who has an issue with their mortgage lender to stop paying their mortgage. Much better to try to engage in order to deal with any issues. And "them" here is actually "us" since @Mothergoose is (I presume) herself an owner occupier and member of the management company.

Did you not get a receipt for payment last year ? You should also get a statement of affairs and accounts usually before an agm. Make sure the email is genuine in case it's a fake link :)

Hi! Blackrock1 - no invoice just email with bank details for transfer and details of direct debit payments. I managed to find the OMC via CRO and the company's directors. It seems to be that the OMC is linked to the management company, both appear to have been set up by the original builder of the apartments in 2004. Is this usual?

How is this comparable?

Have they lend money to the property owners?

Have they interacted on any level?

Have they provided a service for which they have been well renumerated for?

I'm genuinely curious?

We elect directors every year at the AGM. There is some continuation and some turnover.

We also vote on and agree the budget. The directors work with the property management company within that.

I don’t think they can just go rouge.

This is the worst course of action you could take and is really bad advice. As other posters have said you need to find out the names of the company directors and call an EGM. If members stop paying fees, insurance for the complex and all other essential services will have to stop. The company will find it difficult to get the debt under control once the current issues have been resolved. Vote the current directors out at the EGM and get involved yourself to sort the issues. The process is outlined in this key post https://www.askaboutmoney.com/threa...partment-development-is-being-managed.231051/

Thanks, Threader - currently the OMC are not replying to my emails and to my request for EGM. Can I set one up on the absence of the OMC's response.

Certainly if you have the names of the other property owners in the development. You need the names of the property owners, not tenants in situ, so a letter-box drop addressed "to whom it may concern" may not get to the right people.

I'm puzzled that is seems as if you didn't get a copy of the constitution / charter for the OMC identifying it and the officers at the time of purchase. Did your solicitor not insist on this being supplied by the vendor and supply it as part of the ownership package?

In this era of GDPR or whatever its called, I'd be quite surprised if anyone but the management company etc have such a mailing list.

All members of the OMC are entitled to this information. All owners, as only owners are allowed as members. They must be able to communicate freely with each other for elections, proposals, AGMs, EGMs, etc in relation to the development; GDPR does not apply within the context of an OMC.
