Can I contact the FSO if I haven't exhausted the banks complaints system. I have emailed the person whose dealing with my complaint saying they have missed the response date but they will probably email me in the morning saying how busy they are and shift my complaint another 4 weeks down the road.Raise a formal complaint in so they have to answer them. The key is to understand what they will give you easily and everything else needs to be a formal complaint, ending with the FSO if required

Not uncommon, but if you are not willing to wait this extra time, simply state this and ask for the final letter asap. Alternatively offer them 2-3 weeks and clearly state you want either the terms of your complaint to be upheld or a final response letter for this date. There tends to be delays in their posting process as they use an international printing company. This was mentioned in another thread somewhere on hereJazzer, they were late responding to my complaint too - about 5/6 days, if I recall correctly and then the letter arrived.
This is classic kbc tactics. They are deliberately trying to kick the can as far down the road as possible for the cohorts that they have have deemed unimpacted. I have engaged with them since January and only yesterday did I get confirmation that they have noted my complaint . I will get a letter out confirming this in 5 working days. In turn it will most likely take them 2 months to refute my claim which is will no doubt be the case. That's 3 months lost before I can log with the FSO. Perhaps That's what pauraic Kissane means by 'tracker fatigue '.. hoping people will just go away and give up..
On Ciara Kelly last Friday week Pauraic gave hope to these cases reacting to a query which came in from a listener.
In my complaint I ask for the correspondent they send to the brokers ,they replied with they issued it to the brokers at that time and they are not issuing it on a case to case bases. They also said i was outside the flyer date by 6 days and my Broker hadn't stated clearly thatbibwas to roll on to a tracker as it wasn't ticked on the application form. Then they went on to say that I was only entitled to a standard rate after my fixed rate expired.when in fact the words STANDARD Variable rate is never mention once on my loan offer letter. Leaving my emotion out of it, Its a very poor response on their behalf.think they will say the cut off is the cut off - similar to those who lost out on trackers when they were removed from the market.
They are always going to tell you that Daisy duke, It looks good on their half. You have nothing to lose going to the FSO.They told me quite clearly to go take my case to the FSO. They seem pretty confident on their stance
At the end of every final letter for a complaint, they are legally obligated to tell you what the next steps are if you are not satisfied with their response. In most cases, this is to go to the FSO. Its not really about looking good - its what they have to do.They are always going to tell you that Daisy duke, It looks good on their half.
Except time, energy and the risk of further disappointment. I think you need to take a week, seriously decide if you wish to progress this further and on what grounds. Do you genuinely feel you have a case or is it simply a "its not fair" scenario. I am not trying to put you off going to the FSO, but I do think you need to be realistic about your chances. But you have nothing to lose financially by going to the FSOYou have nothing to lose going to the FSO

As suggested in the above post, I would try and get the Oireachtas committee to get access to this detail first and see how they get on. I imagine they would have a better chance of success initiallynot sending me a copy of the correspondence they send out to Brokers is enough for me to escalate it to the Ombudsman
