My query is regarding the 6 year statute of limitations on unsecured debt i.e credit card. I am aware of the general rules on this but there is one particular area on which I am unclear, the issue being as follows : I had a Halifax ( Bank of Scotland ) credit card on which I made my last payment...
i received a civil bill today from cabot financial over credit card loan from 2012
mbna cancelled credit card march 2012
looking for advice on how to deal with this issue
If you haven't made any payment in the last six years, or acknowledged the debt in writing in the last six years the debt is statute barred. This is your defence to the civil bill so you will probably need a solicitor to file an appearance and submit a defence to the court and Cabot.
hi ravima thanks for reply
is this not statue barred as no payment made
appologies for repeatings txts
thank u demoivir
once again appologies not used to posting .
I don't think there's enough details to say if statute barred or not., hence my initial response.
I note you are a new poster and you should me aware that some financial institutions keep an eye on this BB, so don't post enough details to identify you!!
