written references

Hi, I left my job (had to because of nature of work, I explained that in other topic) and I asked for written references. Several times. My ex boss said that this is no problem but he is extremely busy, or it's to much afford but he will do this.

To be honest I have asked for them as I am afraid that he may give me bad references over the phone. Why? He was not happy about me leaving a company (he knows that it will be hard to find someone on place for a longer period of time). Even now he emailed me back saying that anyone can ring him and he will do this over the phone. I know that there is no possibility to find out what is he saying over the phone. Does he have right to not give me written references?
 
These days companies prefer to give a statement of employment rather than a reference to avoid any future problems, this previous thread refers.
