Who has rights to a brand name

I have seen an instance where a company trading under a name but not actively promoting it's business in Ireland was forced to give up it's .ie domain to a .com that could prove that it was wider known and deserved the right to the .ie

If a company trades in Europe under a domain name and another similar brand spends heavily to become better known, is there any risk that the weaker brand (where confusion arose) may be forced to give up it's name.

Flip side
Also if there is seen to be serious confusion in that the names are similar and operating in the same field and company As (original) clients and partners get confused could they force there hand over the second company's name?
