A Chairde,

A friend of mine has a job in US, but needs to get a VISA before he can take the job. The employer has advised him to setup a company in Ireland, and this will enable him to get VISA he requires.

Does anybody have suggestions how this can be done ??
 
It's been my experience that, in general, US companies have a poor grasp of the immigration laws in their own country. I doubt if it will be as simple as just "setting up a company" for your friend. (And even if it is, your friend should be aware of the implications of company ownership in Ireland).

Does the company have a base in Ireland and if so does your friend work for them - that way he could apply for an L1(b) visa (intra-company).. I think the requirement is a 4-yr degree course and 2 (?or 1) year with the company.
If they don't have a company in Ireland he could go through the H1(b) processing.. need to be quick and get this in ASAP. I have heard stuff about setting up companies here but from what I can tell that is a huge ordeal and there would need to be bank statements etc to back up that it is a valid business. It's really for someone who is setting up a business and needs to recruit people for those positions I think (not too sure about this aspect). Immigration processing has tightened up immensely over the last few years and the processing keeps changing so if he's serious about a move he should speak to an immigration specialist asap. Hope all works out.

At present there is no company, and from DubAmericas mail, looks as if this option is not happening.

My friends prospective employer has offered to sell him half the business , will this make it easier for him to get VISA ????
 
The "prospective employer" has suggested a few ways of "by-passing" the VISA regulations, and is now offering to sell half of their business? How well has your friend researched them? Has he met them physically, e.g. for an interview? It sounds dodgey to me - possibly an advance fee fraud. I'd be very wary.
 
My Friend knows the owner personally, and owner is looking to retire and work other related business interests from the background.


The other partner is american based, but not in the business , would manage/ provide local marketing knowledge.

This is,nt a scam, but getting access to States is very difficult these days.

He should tread very, very carefully - His financial future (and possibly his ability to live in the US) will depend on how good the other partner is. One little dispute between partners and it all falls apart... A Visa isn't a good reason to buy into a business.
