Hi there - my brother has gotten a job offer to start in September but they asked could he start on last week in July. Only thing is he has shares vesting with current company 1st week in August and would like to hang on for them to be bought. the shared will pay a dividend that he is hoping will be of long term value.

Can he sign contract for new job while still under contract for the existing job, although taking accrued holidays etc.,? he can't see anything in his contract that says not but it doesn't sound like revenue would allow it?

if your contract allows it with your current company. Various terms could prevent it e.g non compete clause. One option is to simply approach current employer and ask can you provide notice and take leave. There may be some rules which compel a company to give you your leave rather than pay it out (not sure).

He may be in breach of one or other contract. It depends on how likely the old firm is to find out of course, and if they are likely to take any action if they do.


It also depends on the industry and whether he feels he has any reputation to lose.

Revenue will have no interest.

Yes, loads of people have 2 jobs. He should ask to be put on zero credits in the new job until he gets his final payment from the old employer.
