Hi,

I was promoted to my current job exactly a year ago. It is now a managerial position and I was told verbally that this includes maternity pay, sick pay etc. Now neither of these things have happened in the year. Anyway to cut a long story (a year of misery and stress) short I still do not have my contract for this position. I have asked on average twice a month for just over a year and keep being told oh yeah i'll do that now next week. Now I think my hours are going to be changed also and I don't seem to have a leg to stand on because of my lack of contract. Now I would never usually begin employment without seeing a contract first but this was within (very small) company and i'd been there 3 and half years already.

where do i go from here. I;ve had sleepless nights over work and think no mean pay rise is worth this!

Hi narky

Drawing up a contract of employment is one of those pieces of paperwork which managers hate to do and often don't get around to them.

You have requested this a number of times and they have not responded.

I would recommend that you send a formal letter along the following lines:

As I have asked for a contract on a number of occasions and it has not been given, I thought I would save you time and summarise our agreement reached at our meeting of x/x/08.

Then list out the new salary. The new hours. and the other conditions.

That will force them to respond. If they don't respond, then they would be accepting it by default.

thanks Brendan,

I have already sent an email with these details about 2 months ago. Unfortunately we got a bug on our system and all my old sent items have been wiped so i don't even have proof. Getting very fed up. Hence the name,

Great suggestion from Brendan.
Re-type it, re-send it and print off a copy for yourself.

The email is probably still on the mail server or a backup somewhere. If push comes to shove, you could ask the mail admin to recover it for you.

thanks again

Why wait two weeks? Is there any reasonable prospect that the contract will arrive?

Do you have your initial contract? You could use this as a basis for the updated contract.
