My fiance and I bought an apartment in 2006 and have lived there ever since, claiming TRS as first time buyers. He recently took up a job in London but hopes to return to Dublin in 12-18 months. While he is gone I am still living in the apartment and he returns home some weekends. He will be home in the apartment enough to be considered tax resident in Ireland.
I emailed revenue's paye department to ask if he could keep the apartment as his ppr while he is gone but they replied to say he couldn't as he no longer lived here and I should inform the TRS department in Limerick of the change in circumstances.
I want to keep everything above board but I was wondering if there is some legal way around this? If I understand correctly there can be some discretion around someone's ppr so would it be worth my while getting a tax advisor to liaise with revenue? Or would it be a waste of money with no chance of budging on the ppr status?
Alternatively, as I am now paying the mortgage from my salary while my fiance is away, would it be possible to claim the full amount of mortgage relief myself? The mortgage remains in joint names however.
