Told to re-apply for job for 2nd time, no contract

My nephew has been working in the same place for over 2 years, at first in a full-time summer job, then part-time while still in college, and has been working full-time since finishing college.

When he started he was given a temporary full-time contract which ran out in September 2007.

Then he continued on a part time basis until the end of his college year. He was given no further contract and had to put in for his hours every week.

At the end of the college year, May or June 2008, he started working full time but still wasn't given a contract. Being young, he wasn't too bothered about this so long as he was being paid.

Around May this year he was told to reapply for his job, he was interviewed & told that he had a full time position for summer, still no contract ever arrived.

Now he has been told to re-apply again, but also he has been informed that if his application is successful he will be working a maximum of 2/3 of the hours he currently works. A couple of others in the business have been told to re-apply as well. Job performance is not a problem, apparently these people all work very efficiently.

Also it seems that some people (who don't work there) have been interviewed for jobs this week, so the speculation is that management are trying to get rid of their staff and replace them with lower paid staff.

This is very frustrating for all concerned, but I wonder can it be legal? I had a look at employmentrights.ie but didn't find anything that might help my nephew.
 
Hi there,

It sounds like he may have full time hours but a temp contract. First of all though I would suggest that he explains to the HR department that he does not have a contract and ask them can they provide him with one (start date should reflect when he started if he has not been layed off at any point). Once he sees his contract this should give him further clarity as to what type of contract he is on.

Also I would suggest once the contract is received that he contact the Citizen Information department, http://www.citizensinformation.ie/categories. They can be contacted by phone, email or you can drop in.
