Third level course - claiming back tax

I am hoping to get a straight answer to the following query. I have two opposing inputs and need some guidance as I am ignorant in this matter.

If my brother is going back to college and is not eligible to claim his tax back (upto 1000E) can I make the claim assuming I pay the fee?

Does it matter that I am not attending the course?

Yes if you pay the fees and can prove payment of fees you can claim tax back at the marginal rate.

Relief is given at the standard rate (not the marginal rate).

The person paying the fees receives the relief but if it's a contrived scheme to avail of the relief, relief should be denied.

Don't forget it only applies to the actual tuition fees, not the registeration fee (which it's sounds like it could be given the amount mentioned).

Also, the college must be on one of Revenue's approved lists, see here.
