Tenant subletting a room

Hi Everyone

I’ve a great tenant for the last number of years. John has sublet a room on and off for a number of years without issue (and with my permission).

As he was living on his own for the last while, the most recent lease just has John’s name on it. I used to insist on a new joint lease being signed for both tenants.

My queries are

1. If John sublets with no new lease, will the roommate have residency rights anyway?
2. Should I insist on a new lease with both names?
3. Am I better off just having one tenant on the lease? I’m not concerned about having recourse to a second person re the rent.

Just curious, of what benefit is a lease?

John sounds like an ideal tenant who you are able to trust. So no need to do anything.
 
My only concern would be if John moved out, would his roommate have rights in the apartment? Would I be stuck with the roommate?
 
In my opinion, you should have just one tenant on your lease and one rent payment. Don't give the nod to sub lets.

As you've pointed out, you dont want to be stuck with the flat mate.
