Tenant claims deposit not given back.

Hi All,

Hope I can get some advise on the followig issue.

House owner is renting out a house, without any contract made up.
Tenant pays one months rent and one months rent deposit.
After one month the tenant moves out and landlord gives him the deposit back. Tenant now claims he never got the deposit back.
Neither of them is registred with the PRTB.
Tenant is threating landlord with a procedure through PRTB board?
What are his chances and what will happen you thik?

A bit vague,Mayfair. Why did tenant move out after only one month ? What was original (verbal) agreement ? Was everything purely cash - no receipts ?
 
Sorry was indeed not clear.
I am asking this for a German friend of me. Its actually more complicated.
The landlord lives abroad and rents out the house to a couple.
The couple rented out a room to the guy, took de rent and deposit and paid the deposit back.
No receipts or anything.
Now his employer is calling the landlord about this and threating him with procedures.

First, your last post suggests that the couple let the room to the individual on an informal private basis without the absent LL being aware .
If that is the case then I can't see the reason for the individual's employer to threaten the LL.

Secondly, without knowing what the agreement was between the individual and the couple, and why that person left after only one month , it is impossible to give any proper advice.

Thirdly, two persons say they returned the deposit -one person said he didnt get it.
Two versus one.

Looks messy.
 
Sounds like a sublet, so nothing to do with the landlord.
secondly sounds like a house share, cant see what the PRTB can do.

thirdly when giving money to ANYONE especially cash - you get them to sign a receipt.

I dont see much issue either, but my friend was very worried after the call.
LL doesnt know about it and doesnt care either. The tenants are good friends of him.
The couple put the guy up, temporarily, because he was unable to find a room.
There was no time agreement made. The tenant turned out to be very weird, taking (stealing) stuff in the house, like drinks and washing powder. Leaving the door unlocked for the day with nobody in the house and walking around in his underpants rubbing his thing.
After 2 weeks couple talked to him and said didnt work out and he had to go at the end of the month.
The deposit paid was 275 euro. On the day he left couple returned 175 euro to the tenant, because of the missing stuf and the hoover he broke. This was a brand new hoover, which he set on the stairs for hours and then eventually kicked down the stairs when passing the thing. Also he used sheets from the couple, very exepnsive ones, and they had to throw them out because they were full of blood and other stains.

My friend was so happy he was gone, and now she gets this. Why his employer is calling, i dont know, probably because his communication skills are very low.

Just a thought. You say the tenants are good friends of yours....are they aware that if their landlord is living abroad that they are required to make payments to Revenue on his behalf.

The lack of receipts works both ways. They have no proof of repaying the deposit, but he has no evidence of having paid it.
