I'm just making a general query on Stamp Duty. My wife bought a flat a couple of years ago before we were married which is in her maiden name. We're now in the process of buying our 1st house together which is under the 250k figure. I'm just wondering what the rule is regarding stamp duty. I've never owned a property before but my wife has. Do we still have to pay stamp duty as she isnt a 1st time buyer ? Is there any way around it ? I'm not looking to break any laws but if the property my wife bought was in her maiden name then could I not claim it was a legitimate mistake in not declaring it ?

I'm new to these boards, so please go easy on me....!

I think you know the answer already.
If a non first time buyer purchases with a first time buyer, the latter will lose their first time buyer status.
There is no way around this without evading tax.
