Stamp Duty & Mortgage Interest Relief

Just out of curiosity, if a married couple purchase a house and for stamp duty purposes put the house under one of their names to save on stamp duty (because the other spouse already owns a house), is there a chance of getting caught down the line and having to repay the saved stamp duty?
Also, could the spouse whose name the house is under claim mortgage interest relief, even when the other spouse has already claimed a few years mortgage interest relief from the other house? Just out of curiosity mind!
 
of course theres a chance of 'being caught'. why not do things the correct way from the start and sleep easy?
