Spouse unaware of top up to mortgage

A friend of mine has recently seperated.He has just found out that their mortgage was topped up without his knowledge by €140000. The only time he can recall signing a document without reading it was one which his wife said was in relation to a change of the interest rate on the mortgage.He of course now realises how foolish he was to sign this without reading it first. From my own experience of topping up my mortgage our signatures had to be witnessed in the presence of a solicitor. I am wondering what the legal requirements are?
 
Madilla, a couple of years ago I remortgaged and was sent out paperwork from the bank. On the documents it said I could waive my right to have my signature witnessed by a solicitor. It maybe possible that this was what happened in your friends case.
