Selling house with planning permission

Hi ,

I've gone sale agreed on my house which i'm selling with full planning permission
for a 3 bed attached house. i've just been told by my solicitor that i may be liable to 20% capital gains. i was under impression that i'd only be liable if i sold the site or developed it myself. The site is under 1/2 acre.
