selling a deceased persons house in parallel with probate

Hi all,

Asking this on behalf of family member, who sister died last week(No dependants) so house goes to bothers and sisters.

Can they start to put the house on the market (to catch the selling season) before the will has been read out or probate started?

Assuming the siblings are to inherit, the house can be sold and the cash is then subject to probate. My uncle passed away, RIP, earlier this year and the house has just been sold and the funds are with the solicitor dealing with probate. Hope that helps. An Estate Agent would be familiar with this situation, also ask a solicitor.
 
Property can be sold 'subject to probate'. The buyer generally will not close until the grant has issued, therefore any buyer in a hurry might not want to wait. Probate could take anything from 4 months to a year to issue depending on the circumstances.
