sacking an employee

despite numerous verbal and written warnings and a verbal agreement to a redundancy within six months provided the said employee of 12 years toed the line, he choose to continue in his errand ways and leave me with no choice but to sack him. My question , is this person now entitled to 6 weeks pay in lieu of notice, despite the fact that he's gone beyond trusting and is no longer able to carry out his work.

If the 1st sentence of your posting is indicative of the manner with which you have approached this I would caution you to thread very carefully.

Sacking people is something that not only has to be fair but has to be seen to be fair - to ALL parties.

If the person has 10+ years in the job my understanding is that they are entitled to 6 weeks in lieu of notice.

If you haven't dealt with similar situations in the past I would recommend that you get professional advice on this matter and ensure that emotions are kept to a minimum.
