revenue says we claimed incorrect tax credit and must repay

Hi,

I'm looking for some advice, my partner and I (not married) bought a house together in 2002, had a child in 2003 and separated at the end of that year. He stayed living in the house and paid the mortgage, i moved home with my mother and our son. We hoped the split would be temporary but after some time we decided to split permanently and he was to buy me out of the house. In 2008 we got back together and i moved back into the home in 2009 we had another child together in 2010 (and another in earlier this month). Both of us were working full time for all that time. last year we noticed my partners tax credit has been reduced to 2.97 per week, when we contacted the revenue they advised we had both been claiming one parent family tax credit from 2003 to 2009 and we shouldn't have been when we explained our case they said prove it and we're at a stalemate. meanwhile we are down around €80 per week...... this seems so unfair, is there anything we can do???

Do you have any proof that you were living at an alternative address during this period? For e.g. bank statements, credit card statements, your revenue records, social welfare, motor vehicle records, driving licence, passport etc

If you do, you may be able to prove a case, if not it may be more difficult.
 
Ya I agree.

Get your info together to prove that you were living at your parents house. Then get the name of an inspector in your tax office. Make contact with then and send in your evidence. Your looking at 6 years of about 3k in credits, might be worth getting an accountant to advise on the evidence needed but meet the inspector yourself.
 
I don't see anything unreasonable here. You've just to prove the situation to revenue and it's easily resolved. Between the two of you it should be easy. Apart from the bills Nutso mentioned, school records of parents address etc.
 
Not sure if this could also kick up a problem with your TRS as I understand you need to be living in the house to be claiming this maybe some one could advise.

if you were not living in the house and claiming TRS for your share of the mortgage they might say you owe them for this instead.
 
Thanks for your replies - have been on to the bank, they have no record of me changing addresses, will try the school and the insurance company!!!
