My employer never communicated with me during this time.He still has my P45.I offered a cert on the first week but I was told that they were not required(as no company sick pay).I have sent weekly certs to Social Welfare & recieved Disability Benifit.
My employer does not want me back to work. However I have insisted that I am going to return as I am still employed by the company and have never been given notice.Am I right?
I do expect that I may be dismissed however.
Appreciate any advice.

Your employer should give you notice if they no longer require your services. Plus you are entitled to pay for all bank holidays when you were sick and any holiday allowance you did not take. Your employment rights are intatct even though you have been on sick leave. If you are dismissed, make sure you get all your entitlements, and don't be afraid to take the case to a rights commissioner if you are messed about.
good luck,
