Rental Tax Query

Hi there. Myself and my husband are renting out a property we own together.
He is registered as the landlord. He is also on the lower rate of tax. ( I am on higher) When it comes to paying our rental tax later this year, can he fill out the Form 12 himself therefore only having to pay the lower rate of tax?
I'm not trying to avoid tax liability or anything but have to admit it does infuriate me that we have to pay tax on a property that we are still in negative equity on (my problem I know)
 
The rental income accrues to whoever owns the house.

In your case, it's a 50/50 split, as you own the house 50/50.
 
If you have been jointly assessed to date then all income earned jointly is returned same as previous years.
 
You can put anything you want on your form 12/11. Is it correct? You know the answer to that yourself and if you don't the above posters have answered it.
 
Forgetting about the rental income for a minute, are you sure you're making the most of your tax bands if he's in lower tax rate? I.e are you jointly assessed?
