Rent outstanding from previous tenant

My sisters tenant left owing her €20,000 in rent arrears approximately. (He had asked for a reduction of rent during Covid due to his work situation and had promised to pay it back). As they have no forwarding address no RTB proceedings can be issued against them. She has their email address and place of employment and hired a tracing agent to no avail. Any ideas on how to handle this?

You could spend another 20k in legal & still not get anything.

Chalk it up to experience.

All you can do is come down hard as soon as there is one late payment & start proceedings if arrears build.

You could hire a debt collector on a no-win no-fee basis ? Or do what they do and just send letters every few weeks asking for your money in the hope they get a either a conscience or a pain in their behind of receiving same letters.

So finding him would appear to be the first challenge.

Let's assume your sister does, she then takes a case to the RTB. How watertight and well documented - in the eyes of the RTB - was the agreement to temporarily reduce the rent? The fact it persistent past COVID (?) might give it a more permanent feel.

If the tenant argues any 'reinstatement' of previous rent and/or back rent might in fact be a breach of RPZ rules can your sister confidently counter this claim? Worst still if she looses would it impact the current/future rent she can charge.

In short no good deed goes unpunished and it might be best to just

Write it off.
