Removing Employer Details

Apologies, I hope I've picked correct section.

I was unfortunate enough to end up on PUP for extended periods , had a specific roll which essentially merged with other positions, basically reduced staffing. Employer (small) never availed of wage subsidises instead staff had to sign up onto PUP.

Little or no communication, business still trading albeit on a lesser scale. Wages, Holidays , commisions owed and in essence some staff left, others (me) fobbed off.

An employee could not receive any income whilst on PUP and this in essence caused the issue of none payment of wages etc being dragged out.

I had 8 years services prior to being on PUP.

Recently

So, those on PUP, if eligible transfered onto JSB , this happened recently, I am now on this payment.

My knowledge of tax, revenue very limited.

I've discovered I'm still technically employed and Employer details still showing on my revenue account when I got a notification on ypdated TFA. Concerned, I contacted Employer to have me removed, he said he would get back to me. I had to call again and he said I'd have to resign. I explained, I have not resigned and there's an issue with outstanding wages to be discussed. He then said, I could remove my details myself .

There's an added complication , he's my Direct Neighbour and it's apparent now he's avoiding payment of wages and entitlements. Foolishly, I too gave the benefit of doubt, thinking he would address outstanding issues. I was obviously trying to avoid tensions with a neighbour as well as former employer.

I understand, I'll now likely need to lodge a complaint with WRC but my immediate concern is still being technically employed and in receipt of JSB. I understand I'm in suspension from payroll if that makes any sense. I should say very recently my health is such I'll likely end up applying for illness benefit or DA and awaiting diagnosis.

So apologies for the long explanation, my immediate question. Can I now just remove Employer details on my revenue account, are there implications to doing so. I'm just overwhelmed on what to do and I've not received a single payment from Employer in almost 14 months and don't inadvertently want to effect my current JSB.

firstly don’t panic. Pretty sure there’s a lot of people in the same situation as you. And also v sure you’re not doing anything wrong in relation to JSB.
Whatever you do - do not resign. You’re entitled to any outstanding payments and possibly redundancy. You can however make sure that no tax credits etc are allocated to this employment. Again don’t think it matters for jsb but may do for future employment
 
Thank you , I'm primarily concerned at being perceived to being doing something wrong with regard to my JSB. Employer clearly has no intention of paying me and honestly, I can fight that battle separately when up to it. Just really concerned I'm listed as being technically employed on revenue's systems and I'm clearly not, hence my query would there be implications if I just remove these details.

I'm permitted to do so but it seems that option primarily if "You've left the employment" I did not leave.

There’s no need to remove. Department of social welfare will clearly see you’re not receiving any wages via revenue. Pretty sure they don’t see the ‘employment status’ etc. Just the income or lack thereof

You can cease the employment yourself on your Revenue "My account".
In the PAYE services box select Update job or pension details.
Press start and follow the instructions.

Thank you , my concern is implications of doing this as I don't want be then in a position were an impression is given, I left the job. In essence I've not received a single payment from this employer in over 14 months and he won't remove me , I assume because of outstanding wages and possible redundancy entitlements (that's not been admitted) his response is to remove myself, there's also the concern as to how this reflect on my JSB which I automatically transferred too having been on PUP.
 
You can leave the employment details on Revenue. As no earnings are showing for it there will be no problems. You might just have to manually adjust your Tax credits and bands to remove any that might be allocated to the rogue employer. You are continuing to suffer loss of earnings so it should not effect your JSB.
 
Thanks so much , it would seem the consensus is do nothing then . I've heard about bad experiences with employers but honestly never thought I'd experience such a state of affairs. I let my neighbourly concerns trump what should have been sorted a long time ago. PUP was sincerely appreciated but it restricted employee's as outstanding wages etc were left to languish or perhaps conveniently forgotten about.
