I am executor of my fathers will. He bequeathed my 2 sisters and I everything in a 2O% 4O% 4O% split. We want an equal split. The solicitor says that we all need to assend the will (give up our bequest). The will then automatically returns to the 3 of us in an equal split. Us gifting her would result in her paying cgi. Does this sound like a good plan? Our mother has also passed on and my father has no siblings. We each have children. Any input would be grateful. It sounds a bit risky to me.

Sounds a bit odd to me too, but I suppose if all of the beneficiaries disclaim the gifts, AND THERE'S NO RESIDUARY BENEFICIARY, then the gifts would fall into an intestacy. In that situation it would be split equally among the children, since your mother is deceased already.

I don't know about the tax implications. I reckon you'd want good tax advice on that.
