PRSI record screwed

Hello everyone. To any of the company experts out there...

A friend of mine (John) has been working part time for the last 3 years making 100 euro a week.

His boss wants to close the company now. Himself and the boss are the only employees.

John checked his PRSI records with revenue and they are totally wrong. There is at least a year and a half of no PRSI record at all for him.

He approached the boss about it who said he doesn't know how the errors occurred but it would be too costly to rectify now. He has large debts and is sick of that's the reason he wants to close the business.

Is there a way John can get his PRSI records fixed at this point?

Yes. As long as he can provide satisfactory evidence, ie bank statements showing the regular payment of wages, then he has to be given credit for the period worked. He should bear in mind that it's likely that Welfare will have a good close look at him though, and since the situation may be arising as a result of fraud / negligence on the part of Johns employer, he could be landed in hot water.

If the employer wasn't completing the correct recturns to revenue, it will look like John wasn't working there so without proof of payments it can be difficult to get his record straightened. Proof could be bank statement of regular wages, payslips and his P60 - hopefully he has these at least even if it was a cash payment of wages. John's employer is obliged to keep records of payroll for 7 years so John could ask for a copy of the info. If employer still being difficult, it would sound dodgy IMO.

At a very minimum everyone should keep their weekly/monthly payslips until they have received year end P60.
