Our company has been taken over: Do I qualify for payout?

Hi,

Our company has been taken over. As part of this, there are two part payments. The first small payment was paid to everyone.
However, it has been stated that

"To qualify for this final payment, you must have been in the continuous
employment of our company between 1st December, 2002 and 30th
June, 2006."

As I started in January 2003, would I not qualify for this payment?

if It was me and I was paranoid I'd think the date was set specifically to exclude me...how many other employees are in similar boat?

Are you in a trade union?

Since this type of payment is not mandated by leglislation, is the company buying out some inherited rights? If so who has the company negotiated with?

It is possible that the company might include you in the payments, if only to ensure that you dont ask awkward questions!

Remember that under the Transfer of Undertakings leglislation that your terms and conditions cannot be changed unless by negotiation with employees or their representatives.
