Hi All,

My brother and his family are currently renting a property. They initially had a 1 year lease but this finished a few months ago and no new lease was signed. They paid a deposit and 1 months rent in advance.

They are now looking at moving. How much notice do they have to give and what is the situation regarding the deposit - I presume as long as the house is as it was found, they get their deposit back regardless of the amount of notice given?

The notice period required according to Threshold is 42 days. The deposit should be returned within a reasonable amount of time if there are no rent arrears, if the tenant has given the required notice, if there are no outstanding bills and if the property is in good condition.
 
As commonsense states, they need to give the legally required notice period as they are now in a Part IV tenancy. If they were to move before then they would potentially be liable for rent to the end of the required notice period. A shorter notice period may be negotiated with the landlord but if this happens they should be sure to get it in writing from the landlord that there will be no financial penalty for early termination.
