Notice Period is 3 months

I've just been offered an external position, which is far superior to my present job, and told them that my notice period is 1mth (they need someone ASAP).

I've just checked my Contract, and it states 3 months! I never realised this. Is this not excessive, as I would never be able to move on to bigger & better things with that lengthy notice period.

Can anybody please help? What should I do?

Its is normal for senior positions as they need time to source someone else.

You could probably strike a deal and take you holidays etc.

I seem to remember this being discussed here before. If I recall correctly the consensus seemed to be that it would be extremely unlikely that any action would be taken against you if you were to give less than the contracted amount of notice. Assuming that you're not talking about a CEO level position or similar, is it even likely that a court would enforce any such action that a company might take?

I was in a similar position and left a job that had a contractual 3 month notice period giving only 1 month's notice, this was by agreement however, perhaps your current employer would also be amenable to this?

It's actually not that uncommon, especially for management positions. However, depending on the circumstances and where you are going to, many employers will waive the additional 2 months or allow you to offset holiday leave against some of it on the grounds that you'll no longer be fully motivated in your role

If you are joining a competitior, there may be 2 reactions, either refusing to waive the notice period and force you to work it out, or put you on gardening leave straight away.

No, it's actually a role in a completely different industry.

I'm just worrying that if they are insistent that I work the 3 months notice, I will have to refuse on the basis that it will be a barrier to my career progression, as the Offer is such that I would not get again for quite a long time; if I do hang on the 3 months, the 'new Employer' won't wait for me, and there would be no job waiting for me at the end of this time!

Ask you manager, if he insists you stick by contract, send him letter stating you are leaving in month.

They can bring you to LRC / LC , are they can only recomend ...

Enjoy the new role !!!!!!!

P.S. If in different industry, do you care about Ref.
 
I know, I know.

I did actually read the Contract, but obviously not well enough. A valuable lesson has been learned here.
 
Would be very difficult for them to hold you too it. Other thing I would look at is what notice do they need to give you, would bet its not three months. Only problem may be in the future if you need a reference.

Ok guys, my boss has agreed to my 'early' departure, but I don't think he has realised that I am on Annual Leave the week preceding, which he approved long before I handed in my notice.

I haven't pointed this out to him, although he should really know himself. Should I keep shtum, or come clean? if I come clean, he will probably flip & insist I stay longer.
 
Will you ever be looking for a reference from this employer?
Do you have enough respect for them not to mess them around?
 
As the Industry I am going to is completely different, I would not be requiring a reference from my existing Employer going forward.


Actually Clubman, I don't think I have been, as you put it "messing them around" at all.

I have been offered a position by a 3rd Party that significantly benefits myself and my family, and I merely was looking for advise/help. If I wasn't bothered about my current Employer, then I wouldn't be worried about it.

You might need a reference for a "skills based" CV in the future though?
