Non resident CGT review

Hi,

I’m in the middle of the non-resident CGT review following sale of a property in Ireland. Everything is submitted and I understand revenue have 35 business days to assess the information (there should be no problems) but the 35 days is a problem for me. Is there is any experience as to how long it is likely to take or is it a day 34 kind of thing?

When the request is submitted the applicant will receive an automated reply stating that if Revenue do not respond within 35 working days, they can distribute the sales proceeds to the non-resident vendor. There will be no requirement for a further letter from Revenue to issue providing clearance to the applicant if Revenue do not respond within 35 days. The automated reply will be sufficient to allow the representative to distribute after the timeframe of 35 working days has elapsed and no contact has been made by Revenue in relation to the application for clearance.
 
It can be cleared in a day or two IF you submit a comprehensive and crystal clear application AND you're sufficiently lucky that someone looks at it that quickly.

The former is within your control, the latter unfortunately isn't.
 
It took almost a month to get the clearance, though it shouldn’t have taken that long - it only took revenue around two weeks to look at the material.

Unfortunately the first time revenue looked at it they decided something was missing and sent my solicitor a question. My solicitor never saw it. I ended up calling and politely asking about it, where one of the very friendly revenue folk told me about the question. I clarified it was in the submitted documents and he was surprised that the question was raised - he cleared it that afternoon.
