New RAS Scheme 'Designed with Landlords in mind'

Details here of a new RAS scheme apparently designed with landlords in mind.

Rent is guaranteed and can be up to market rent. It is paid even if the property is vacant. Both of these are attractive.

But there are some issues - the local council picks the tenant and the landlord manages the property as in a normal tenancy. So, even though the landlord hasn't chosen the tenant, he is still responsible if the tenant engages in anti-social behaviour, for example. Once you sign up, presumably you've no say over who your tenant is.

The term is 8 years. How does that fit in with the 6 year/unlimited tenancy cycles. If you are a small landlord, is it really 8 years? If you are a large landlord are you in reality signing up to the permanent tenancy and one possibly to the tenant's children as well. Did they miss that bit when they came up with 8 years.

Negatory in the extreme to this. I spend an a lot of time picking the right tenants, not just to ensure the property is kept well but that the neighbours are not tasked with dealing with the dregs of society.

I have a nightmare tenant with the LTL. The council were absolutely no help at all. They put the worst person on the face of the earth into the apartment. It was supposed to be totally hands off and yet I am getting threatening emails and phone calls at least once a month from neighbours and the MC. The council do nothing at all when I forward these emails on to them.
I would hate to see how the council are when they can wash their hands of dealing with their tenants too.
That scheme would be a hard NO from me. Even worse than regular letting. You would want to be a masochist to sign up to that.
As it is i cannot wait for the day my lease with the council ends.

Government press release issued on this new RAS scheme.

One part that caught by eye - there will be enhanced damage and compensation arrangements for the landlord ie. danger money.

That clearly shows what landlords would be getting themselves into with this new scheme.

Maybe they should state if they will deal with and remove one of their anti-social tenants. BEcause in my experience, once someone is in, they will just answer every contact with ....GDPR .... indivisual cases .... being looked into .... rest assured. And then do absolutley nothing.

If you want to rent your property make sure that you are not left dealing with a tenant you have not vetted and picked yourself. You are just asking for trouble.

It is very clear from the Scheme that they pick the tenant and the landlord has no say in the matter at all.

God help the poor people living nearby. It is wrong on every level and just a way to wash their hands of having to deal with those who are not able to live beside others without causing trouble.
Sadly there are plenty of landlords who will take up this offer!

I learned long ago that its next to impossible to help or guide stupid people. You may as well be talking to the wall.

No doubt there will be Landlords whooping with joy on reading the opening post ( Homer Simpson types) and not bothering to read the subsequent posts such will be their haste to contact the Council.

Likely worried they'd miss the gravy train. :)

Are you including all of the posters who blame the RTB and the opposition parties all of the time whenever a new rule is brought in to try and sort out the mess created by both parties in power when they sold off most of the Council housing stock and transferred people who should be housed by the state on to willing landlords who are only copping on now to the mess they took on by housing people the state should have housed in the first place,

I am a landlord I don't mind paying tax to house people the state should house,

Every time I relet the one question I ask myself is this a tenant the state should be housing if I think it is I leave them to the state or landlords with no cop on,

Ive read this somewhere before :)

sorry it just sounded so familiar that I thought it was a copy and paste
A lot of landlords don't get it all the new rules and regulation we are seeing at the present time has got nothing to do with Left-wing or Right-wing politics,
their is a reason why we see no pushback from the Independent TDs and Senators who support the last few government who are also Landlords,

Sorry if I missed it, but who provides the maintenance for the property over this eight year period?

The landlord.

From the Dublin City Council press release on this here

  • The local authority pays the full rent directly to the landlord
  • The tenant is nominated by the council and has been assessed as having a long-term housing need
  • The tenancy is governed by the Residential Tenancies Act 2004
  • Landlords continue to manage the tenancy and maintain the property, as in the private rental market
So despite the fact that the landlord has no say over who the tenant is, managing the tenancy and dealing with any anti-social behaviour falls on the landlord.

As the tenancy is governed by the Residential Tenancy Acts the 6 year/permanent cycles would apply. I don't know how that fits in with the 8 year term. A small landlord would presumably end up with a 12 year tenancy ie. no break at year 6 as they've signed up for 8 years with the Council. A large landlord would have a forever tenant and their children could take over. Signing up for 8 years with the Council would not override the permanent tenancy created by the most recent Act.
