Neighbours meat-smoking fumes making garden unusable

Thanks so much all for your advice and suggestions, I'm very grateful. I think I might just email the council in the first instance with some photos and a video clip to ascertain as to whether the chimney set-up and smoke etc do indeed fall under any emission regs and take it from there, as I'm loathe to start any kind of outright war, since I'm not the one living there. But it's not nice to see my mother's garden under siege either.

To be effective as quickly as possible , any of the trees or hedging that might be first choice rootstock are likely to be ugly, fast-growing non-native evergreens planted as close as possible to the fence, screening the fence and cabin completely,
I did have that thought but unfortunately any hedging or tree installation would take years to grow until it could block the chimney, which appears a good four or five metres above the wall.

The roof of an exempted outbuilding can be no more than 4 metres. I presume that includes a chimney.

4 or 5 metres above the garden wall ,thats not a bbq flu but an industrial type chimney. They need the height to create a draw for the chimney. There is no way a chimney like that could be allowed in a suburban garden, even houses in the country now can only get planning permission without a chimney.
However if the chimney was that high surely it would be putting smoke out of range of your mothers garden although it would affect the second story of the house possibly.

That's a shame that you got such a negative response from the neighbour. In light of that, I wouldn't hold back and would certainly enquire with the council to see if they are breaking any regulations. I wouldn't care that they know where it comes from, they are in the wrong and are not considerate of their neighbours or the impact their smoke it causing. It is 100% on them, no one else.

Complaint from residents to planning commission regarding smoke emissions from a commercial wood-fired pizza business.

To the OP, perhaps your mother could complain to the local authority on health grounds?

Murphy – whose home at Mart Lane, Foxrock is close to the Fired Up pizza operation – has told An Coimisiún Pleanála (ACP) that it is her medical opinion that recurring smoke emissions and repeated exposure to wood-fired particulates are sufficient to give rise to upper airway irritation symptoms and materially intervene with the residential enjoyment of the dwelling and rear garden area.

Murphy said that based on her direct observations as a resident and homeowner, “the intensity of the smoke impacts varies depending on the prevailing wind direction and atmospheric conditions; however, there are repeated occasions where smoke accumulates within the back garden and where smoke odour enters the dwelling unless windows and doors are closed”.
