Mid-night abusive phone calls from Tenants

Hi,

Looking for some advice -

Just to brief the situation, I have new tenants (two guys) whose lease agreement for six months started in Feb this year. The very first day I asked them to setup a standing order but they did not and they do not even bother to lodge the rent until I ring them. Last month I had to make n number of phone calls and it caused a lot of hassle, delayed the rent by 10 days. I asked them again to setup a standing order but as usual false promises (by one guy) that it will be done today or tommo or so on. Other guy who sleeps during the day time time was pi ** ed off with the messages I sent asking the status of standing order starting making abusive phone calls during the middle of the night and would not stop ...

The tenancy is registered with PRTB.

Very confused and not sure how to handle the situation; any ideas please?

Forget about texts and 'phone contact. Write them a letter (calmly and objectively) stating the facts and advising them that if another payment is late they'll have to leave, as they have breached the terms of the lease. Ask to visit the property now and take some photos in case of any malicious damage.

However, the format of evicting tenants for rent arrears, under a Fixed term lease agreement, is that first, you must issue a 14 day notice of rent arrears, which if not paid within the 14 days, you can then issue a Notice of Termination which gives the tenant 28 days in which to vacate the property. Perhaps an initial 14day notice may just concentrate their minds. It is the obligation of the tenant to pay the rent on time and not for the landlord to go looking for it. Many leases have a clause that should any letter be sent to the tenant as regards late payment of rent, there will be a charge of 20 euros.

OP, as DrMoriarty suggests, go for an Inspection of the property immediately (notice required to the tenant "on a date and time agreed in advance with the tenant").

Personally I'd evict them on that basis alone. I'd keep a record of the phone calls received and at what time. Someone who is continually late with the rent is only going to get worse.
 
If the calls continue, I'd recommend you contact the Gardai. That way, you can give him the option of leaving or having the issue escalated.
