Maternity Benefit...will I qualify?

Hi,

My employer offer maternity top up benefit for all employees who have completed 2yrs continuous service 'at the time of going on maternity leave' and it states in the hand book that you must start your leave at lease 2 weeks before the baby's due date. My problem is that I would be due on the day that I am there two years and so as I would need to have started my maternity leave 2 weeks before that date I would not qualify under the company policy.. by just two weeks!!!
My question is could I take those two weeks from my normal holiday entitlement and then take maternity leave to ensure I qualify? So in effect tack on two weeks normal holiday in front of my maternity leave? If I could do this what would happen if the baby was born early within the two weeks I was on holiday, would I lose my entitlement?

I appreciate any help or advice you can offer.

Many thanks

Maybe the first thing is to ask your employer would they have any flexibility in terms of offering the salary topup should you start maternity leave 102 instead of 104 weeks into your employment with them. If they agree then problem solved?

or get your doctor to say you are due 2 weeks later than you are on maternity leave form and take the 2 weeks as holidays if in doubt. I was asked what date i wanted put on my form though i did go by real due date cos I wanted out!

Is this approach/advice kosher?

lots of people go over by 2 weeks on first baby and lots of people work up until the end so they get the 2 weeks after baby is born. If baby is born before maternity leave maternity leave automatically starts that day anyway.

Book your two weeks holiday and then start maternity leave immediately after it. You're entitled to your holiday and that way you will have your 2 years continuous service. Also, you won't really lose out on holidays as you will have an extra 2 weeks at end of your maternity leave.

Thanks all for you replies ..... my employer is unlikely to be very flexible on this.. but am sue we will figure somthing out. thanks again.
