I'm looking for someone who specialises in this area (contracts of indefinite duration) as have been on a yearly contract for 10 years with a public body and have just been given a new contract for a lower grade and lower salary and am wondering what my rights are. eg. I've paid % for pension at much higher salary.

Are you asking for a solicitor recommendation?

Do involve your union, but take legal advice as well. Unions are sometimes useful and sometimes not.

A friend who was in a similar situation got nowhere with employer or union unti a solicitor was involved and then she got her permanent contract with no argument at all. So do get legal advice from a solicitor who specialises in employment.

I've spoken to the union who think I should be entitled to it but I do think I need a solicitor involved so yes, I'm looking fro a solicitor recommendation who specialises in employment law and ideally has experience in the area of contracts of indefinite duration. I've seen some recommendations on this site for solicitors and when you ring, they all say they do general employment law so its hard to know who has actual experience needed. Diziet, would you friend's solicitor happen to be Dublin based and if so, could you find out who it was? thanks

I am afraid my friend is in Cork so a recommendation would not be of use to you! There is another forum here where you can ask for a specific recommendation: http://www.askaboutmoney.com/forumdisplay.php?f=75 . It would be worth another post there. I am sure there was a post about recommending an employment solicitor a while back, but I can't find it.

Another way would be to look in the Labour court records (they are on the net) and see if there are similar cases and note down the solicitor firm?

Write to the HR department and ask them for the basis of issuing you a contract for grade A as you were expecting a contract for the grade of X. I don't think you need a solictor for this.

Were you always employed at the higher grade and if so for what reason.

Found a recommendation on this site from Brendan for O'Meara Geraghty Mc Court at the following link:
http://www.askaboutmoney.com/showthread.php?t=1174&highlight=Ciaran+O%27Meara
So am meeting them. they were also listed on labour court site as a claimant's solicitor as per Diziet's recommendation, so will see how I get on. Fees are steep though. Brendan's post in 2004 says Ciaran O'Meara is 300 / hour, he's now 400 plus VAT so I'm hoping its worth it.

Hi- I have lodged a complaint with the LRC against my employer for failing to get a Contract of Indefinite Duration after 5.5 years . Can anyone tell me what to expect at the hearing?

Have you asked your employer for confirmation that you have acquired rights to a CID. Do they have an objective reason not to issue you a CID? Has the employer issued you with a contract and if so, what was the purpose?

Yes have asked but got no response- I'm near the end of my 2nd three year contract ( employed since Jan 2004) so I'm over the 4 year threshold. Am on a "specific purpose contract" which is to implement a plan due to end in 2012. Feel fairly confident re the hearing but want to know what happens- who is there, the procedures etc
