Legal issues of will where there is separation but not divorce

My partner died recently. He made a will leaving his assets to me - we are talking a very small amount. However he was only separated from his wife not divorced. Does she still have a claim on this?

I do have an appointment to see a solicitor soon but would appreciate any information or advice that anyone has as I am lost in this area.

I really don't want more hassle as I am already so upset and annoyed (more than annoyed but I cannot swear on the board) that I was unable to register his death because "I am only a partner" that I am really tempted to just let it go but on the other hand he did make the will so I suppose that I should proceed.
 
Does she still have a claim on this?


Check the terms of the Separation Agreement /Order. She will have had to waive her Succession Act entitlements if she is not to get a share of his estate.
