Landlord sues Council

It should be required reading for anyone thinking of becoming a landlord

"Ms Penston said there were holes in the walls, a downstairs toilet was missing, a bed had been cut in half, there were mattresses in the garden which was covered in rubbish, and copper piping and floor boards had been removed. Many windows and all the doors in the house had been damaged and were off their hinges.

There was "blood and other fluids on the floors" while any furniture was either damaged or missing, she said.

The floors were covered in material ranging from needles and broken glass beer bottles to broken toys. There were no furnishings left, and the upstairs toilet did not function."

...

"Represented by Denis McDonald SC, the council denies it nominated the tenants. The councils says they were in occupation prior to April 2008 when the tenancy agreement was entered into between the council and the landlord."

So it appears that they were initially private sector tenants.

Just like adverts.ie, eBay, amazon etc....
There should be a Voluntary Feedback online service for all tenants and landlords. That way both parties would be more conscious of protecting their reputation.

And here you have a prime example of the State being obliged to house everyone irrespective of the damage they cause. These people should either be refused State support or provided with accommodation suited to their behavior, and going by the details in the article they should be housed in a remote location in a property owned by the State and if they ruin it then let them live in squalor.

Curious.

Also I wonder if the council have an vetting procedure or if its in any contract between LL and Council. I suspect there must be a get out clause there for the council somewhere, or suing them would be far more common.

Is there not a criminal case here for theft that should be reported to the Gardaí? i.e. the missing toilet and copper piping?
