landlord refusing to return deposit.

Hi,

I moved out of the apartment that i rented on April 11th and the landlord is refusing to return the deposit. Throughout my time in the property, the letting agent acted as the management agent for the property and all dealings were done through them. The landlord wanted no contact whatever from us the tenants.
I followed all the moving out steps, written notice 1 month in advance and cleaned the place from top to bottom before moving out. The management agents were happy and said I'd get the full deposit back in a few days.

It's been nearly 8 wks now. After a string of excuses about being out of the country, the landlord said she want to view the apartment before returning the deposit. Several wks later she then disputed that the property was left in the correct condition with the letting agent. She complained of dust in the hoover and crumbs in the toaster to name a few of her insane reasons.
The letting agents are now on longer managing her property as a result of this and I am left with no deposit of approx 1200 Euro.

I have a signed letter from the letting agent saying that I vacated the property in a satisfactory condition and am now faced with a long wait via the PRTB to try to get my money back.
I can't believe how poorly i have been treated in all this bearing in mind that i left the place spotless when i moved out.
 
Good luck with your PRTB case. In some of the retained deposit cases documented on the PRTB website there is also a sum paid in compensation to the tenant in addition to return of the deposit.
 
Unfortunately there is a sub-class of landlord that retain deposits as a matter of course. From the facts as you state them you will win the PRTB case, just make sure you show up and have all relevant documentation. Do let us know how you get on, and what the wait was like!

Just wanted to let people know that the PRTB found in my favor before Christmas and I received my full deposit + €100 extra for the inconvenience caused.

I have to say that I was very impressed with all of the dealings I had with the PRTB. It might have taken a while but I'm glad I stuck with it and hopefully the landlord will think twice before they try to shaft any future tenants that they may have.
 
Good to hear feedback on your result Trevor. I'd say that receiving the sum just before Christmas was a bit of a bonus too....sad that you were only awarded €100 for inconvenience of being without your own money for 8 months tho
 
That's a good outcome. Of course there's always the small claims court if you hadn't been successful with the PRTB but probably a bit harder work I'd imagine.
