Landlord Keeps Deposit

Could anyone please advise. My daughter has just moved house and the landlord of the house she has just vacated kept the €800 deposit. It was in a bad state of decor when she moved in 2 year ago and she redecorated throughout. She also re-decorated the lounge two weeks before leaving so it would be in decent condition.
He made silly complaints which makes me think he always does this. She does acknowledge that the bath is damaged and will need replacing, but this should not cost €800, she needs and account to settle.
The Small Claims Court says that they do not accept “a breach of leasing agreement”
The Private Residential Tenancies Board is not clear as the landlord may not be a member, and suggests the Small Claims Court.
 
If the landlord is registered with the PRTB then this is where you should bring your complaint

If the landlord has not registered with the PRTB then he is in breach of several areas of legislation in this area and the threat of bringing him to their attention should be enough to get your daughter's deposit back.
 
Sorry if I sound condescending but why do people redecorate rented properties. If you are not happy with it dont move in, you will get zero thanks for it usually (as in this case).

Its awkward since she has already moved out. It depends on what relationship she has with him, and how approachable (s)he is. Ask for a breakdown of what the bath/other charges.

IF LL is not registered, threatening reporting him to PTRB/revenue would be my next move
