judicially separated spouse, first time buyer as other spouse had name on all docs of family home that will sell, would I be eligible for first time buyers mortgage interest relief?:rolleyes:any views appreciated! (family home will sell)
 
You are only a first time buyer for stamp duty purposes if you cease to retain an interest in the family home (some other conditions apply also - see www.citizensinformation.ie) and the other party continues to live in the family home.

Whose name the property was in is irrelevant, so long as you were married the house is considered to the Family Home within the meaning of the act.

So far as I can recall (but willing to be corrected) it is time based and doesn't relate to whether or not this is your 1st or 40th home
