Is it leagal/illegal to produce a recording at a prtb hearing as evidence. Could the tenant sue me etc for producing a recorded message I made of a conversation made between us. This recording was made without his knowledge.

Produce a typed transcript of the conversation (verbatim) and tell them this is your memory of the conversation (assuming its a conversation).

Any time I was with the PRTB I had to produce the documents before a hearing, so if the transcript was sent to the adjudicator and then to the tenant it may have the desired effect........

Is it legal to just advise someone that a recording will be made of a conversation and then, if necessary use it as proof of something?

Scenarios:
1. Recording a phone call (as do may phone help lines) who just advise you before any conversation commences.

2. Recording of anti-social behaviour - not necessarily for the words spoken (though may be useful in the case of frequent (and loud) swearing, and to help in ascertaining the amount of noise.

My (unqualified) understanding is that if you obtain consent/permission beforehand, then it's legal and can be used in whatever process that may arise afterwards.

What specifically is the scenario? You're putting through a call to someone - who's cooperation you have in keeping the phone in earshot of some disturbance or other??

If you state the call is been recorded in advance therby you are giving the other person the opportunity to decline or hang up, not the same as recording without consent

Also there would be a difference between civil matters (prtb) and possible criminal matters (anti social behavour) and what gardai may be able to use
